Overseas based Guyanese accuses attorney at Law of misconduct

An overseas based Guyanese pensioner of No 9 Village West Coast has written to the Legal Practitioners Committee of Guyana for action to be taken against an attorney at Law for acting inappropriately.
The woman, Claudette Nedd, is taking action against attorney Deenawati Panday whose office is situated at Cheddi Jagan Street and Lot 7 Strand New Amsterdam Berbice. She wants Ms. Panday to be disciplined for conduct unbecoming of her professions as an attorney at law.
According to court documents the attorney and Claudette Nedd were on separate side of court litigation which began in 2014. The matter reportedly went on until 2019.
The woman brought an action in the High Court through her then lawyer the late Lloyd Thomas against one Anita Nedd. The order was for Anita to transfer title to parcels 148 and 178, Zone B.RW, Block IV, being parts of No. 9 Village, West Coast Berbice to her.
Attorney Panday appeared for Anita while Thomas appeared for her. The matter came up for hearing in March 2018 before Justice Gino Persaud.
A consent order was subsequently made by the Judge for her to pay Anita Nedd the sum of $2M for her to transfer the land to her.
That transaction was completed during the said month up to the stage where her attorney handed over the said sum of $2M to Ms Panday and a receipt was given.
Despite that, Claudette is claiming that up to date Ms. Panday has not given her a receipt from Anita Nedd for the $2M. This is despite numerous requests made by her and written request by attorney at law Senior Council, Mr. Murseline Bacchus who is her now attorney.
She said that in her absence she was represented by her Power of Attorney Sheldon Alan Mc Curdy by Deed of attorney 2689 of 2018.
She stated that during the time Ms Panday never made any effort to prepare the documents for the transfer of the Title to her as agreed.
She further stated that around December, 2021 she discovered that Ms. Panday sent for Mc Curdy and prepared a document for Anita Nedd to appoint him as her agent even though she knew that Mc Curdy was her agent. She subsequently registered the document in the court.
She further contended that despite the contents of the standing contract in the order before the courts, Ms. Panday through the purported Double agent, Mc Curdy prepared a fresh agreement of sale for the said parcels of land.
The purchase price being $600,000 and that Anita Nedd would pay all Registrar’s fees, duty and legal expenses. Despite that Ms Panday demanded through her agent the sum of $44,000 for which a receipt was issued.
The woman stated that due to the action of attorney Panday she has still suffers mental and emotional anguish and fatigue due to what has happen to her.
She is asking the Legal Practitioners Committee to strike Ms. Panday off the Court Roll or that she be suspended from practising as an Attorney-at-Law. She is also asking for compensation or damages in excess of $10M for losses she has suffered.
